Ovi Uvjeti kupnje dio su obveze Prodavatelja sukladno odredbama Zakona o
zaštiti potrošača, te služe tome da Kupac prije nego sklopi ugovor na daljinu
bude na jasan i razumljiv način obaviješten o nizu okolnosti bitnih za
zaključenje, izvršavanje, raskid ugovora, a sve sukladno zakonskom uređenju.
- Pristupanjem stranici, prihvaćate sva pravila i uvjete korištenja ovih stranica.
Zadržavamo pravo promjene i modifikacije uvjeta korištenja stranice u bilo
kojem trenutku. Promjene stupaju na snagu od trenutka objave. Korisnik je
dužan redovito čitati uvjete korištenja, te se smatra da je pristupanjem
stranicama upoznat uvjetima korištenja istih. - Ovi uvjeti korištenja su sastavljeni u skladu sa Zakonom o zaštiti potrošača
(dalje u tekstu: ZZP), Zakonom o elektroničkoj trgovini (dalje u tekstu: ZET) i
Zakonom o obveznim odnosima (dalje u tekstu: ZOO) te zajedno sa podacima
objavljenim na internet starnici www.bazeni4you.com predstavljaju
predugovornu obavijest u smislu članka 57. ZZP. Korištenjem
www.bazeni4you.com smatra se da je korisnik upoznat sa ovim uvjetima
korištenja te da iste prihvaća. Prodavatelj otklanja svaku odgovornost za sva
sporna pitanja koja bi eventualno mogla proizaći iz razloga što posjetitelj
stranica, korisnik i/ili kupac nije pročitao uvjete korištenja te navedene zakone. - UVJETI PRODAJE
I) Sklapanje i raskid ugovora o prodaji
Usluge bazeni4you.com webshopa mogu koristiti samo osobe starije od 18
godina.
Ovi Uvjeti kao i pojedini uvjeti prodaje naznačeni uz informacije o određenim
proizvodima predstavljaju ponudu bazeni4you za sklapanje Ugovora te korisnik
kao kupac svojom registracijom, zaključivanjem narudžbe ili na drugi način
utvrđen ovim Uvjetima iste prihvaća čime se smatra da je zaključen Ugovor
između korisnika i bazeni4you, a prema uvjetima prodaje navedenim u ovim
Uvjetima.
Predmet i komercijalna svrha Ugovora je kupnja odabranog proizvoda putem
bazeni4you.com internet stranice uz plaćanje odgovarajuće naknade – cijene
toga proizvoda ili usluge. Ugovor se zaključuje sredstvima daljinske
komunikacije (Ugovor sklopljen na daljinu) i to putem: tiskanih promidžbenih
poruka s narudžbenicom, telefona s ljudskim posredovanjem i bez njega te
Interneta.
Ugovor stupa na snagu i obvezuje od trenutka kada korisnik prihvati ponudu
bazeni4you odabirom plaćanja i dovršenjem narudžbe putem interneta.
Da bi korisnik mogao ostvariti pravo na jednostrani raskid Ugovora, mora
obavijestiti bazeni4you o svojoj odluci o jednostranom raskidu Ugovora prije
isteka roka i to nedvosmislenom izjavom poslanom poštom (na Klepić d.o.o.
Odranska 23, 10412 Donja Lomnica) ili elektroničkom poštom
na bazeni4you@gmail.com ili info@bazeni4you.com, u kojoj ćete navesti svoje ime i prezime, adresu,
broj telefona, telefaksa ili adresu elektroničke pošte.
Rok za jednostrani raskid Ugovora iznosi 14 (četrnaest) dana od dana kada je
korisniku ili trećoj osobi koju je korisnik odredio, a koja nije prijevoznik, roba
koja je predmet Ugovora predana u posjed.
Ako korisnik jednostrano raskine Ugovor, izvršit će mu se povrat novca koji je
od njega primljen, uključujući i troškove isporuke, bez odgađanja, a najkasnije
u roku od 14 (četrnaest) dana od dana kada bazeni4you zaprimi korisnikovu
odluku o jednostranom raskidu Ugovora, osim ukoliko je korisnik odabrao
drugu vrstu isporuke, a koja nije najjeftinija standardna isporuka koja je
ponuđena. Povrat novca bit će izvršen na isti način na koji je korisnik izvršio
uplatu. U slučaju da korisnik pristaje na drugi način povrata plaćenog iznosa,
ne snosi nikakve troškove u odnosu na povrat. Povrat novca bazeni4you može
izvršiti tek nakon što mu roba bude vraćena ili nakon što mu bude dostavljen
dokaz da je roba poslana nazad.
Korisnik je dužan robu poslati na adresu Klepić d.o.o. Odranska 23, 10412
Donja Lomnica, bez nepotrebnog odgađanja, a u svakom slučaju najkasnije u
roku od 14 (četrnaest) dana od dana kada je bazeni4you-u uputio svoju odluku
o jednostranom raskidu Ugovora. Izravne troškove povrata robe korisnik mora
snositi sam. Korisnika se moli da prije raskida Ugovora javi
na bazeni4you@gmail.com ili info@bazeni4you.com kako bi mu bio objašnjen postupak vraćanja robe.
Korisnik je odgovoran za svako umanjenje vrijednosti robe koje je rezultat
rukovanja robom, osim onog koje je bilo potrebno za utvrđivanje prirode,
obilježja i funkcionalnosti robe.
Ako je na zahtjev korisnika izvršavanje usluge započelo tijekom roka za
jednostrani raskid Ugovora, korisnik je dužan platiti bazeni4you-u iznos koji je
razmjeran onom što je isporučeno do trenutka kada je korisnik obavijestio
bazeni4you o jednostranom raskidu Ugovora.
II) Uvjeti i postupak kupnje
Glavne karakteristike proizvoda, način uporabe, cijene, posebne akcije i
pogodnosti, načini plaćanja i dostave odnose se na one koji su važeći u
trenutku zaključene narudžbe. Navedeni podaci će biti naznačeni uz svaki
proizvod.
U cijene proizvoda nisu uključeni troškovi dostave iz razloga se isti posebno
plaćaju, osim na narudžbe iznad određenog iznosa kada je dostava besplatna,
a sve sukladno uvjetima i na način kako je to naznačeno ovim Uvjetima kupnje.
Prije potvrde narudžbe odvojeno je iskazana cijena proizvoda, cijena dostave
ako je naplatna, cijena PDV-a, te konačna cijena kako bi Kupac imao uvid u
konačnu cijenu koju plaća za naručeni proizvod.
Sve cijene su izražene u hrvatskim kunama (HRK). U sve cijene je uračunat
PDV. Konačna naplata vrši se isključivo u
hrvatskim kunama (HRK).
Sve transakcije ćemo provjeriti prije slanja pošiljke. Pošiljka se ne šalje dok
sredstva nisu vidljiva na našem računu. Navedena provjera može trajati
između jedan do tri radna dana.
Ukoliko kupac ne zaprimi obavijest o potvrdi narudžbe, postoji mogućnost da je
pogrešno unio adresu svoje elektronske pošte. U tom slučaju molimo kupca da
nas kontaktira na: bazeni4you@gmail.com ili info@bazeni4you.com kako bi naša služba za korisnike
provjerila je li narudžba zaprimljena. Ukoliko niste sigurni kako izvršiti kupnju,
slobodno nas kontaktirate na bazeni4you@gmail.com ili info@bazeni4you.com i pomoći ćemo vam kod
narudžbe.
III) Dostava i uvjeti dostave
• trošak dostave obračunava se prilikom kupnje proizvoda i izdaja Vam se
račun na kojem se nalazi cijena kupljenih proizvoda i cijena dostave
• trošak dostave bit će iskazan u ponudi nakon dodavanja artikla u košaricu i
odabira načina dostave
• trošak dostave na području Republike Hrvatske ovisi o težini proizvoda te će
biti izračunat nakon dodavanja u košaricu i potvrde države dostave
• roba se šalje isti ili najkasnije sljedeći radni dan ukoliko se nalazi na
zalihi. Roba će kod kupca biti dostavljena najčešće sljedeći radni dan ili dva
dana (otoci, sami jug Hrvatske) za Hrvatsku od dana slanja pošiljke najčešće u
roku od 3 dana. Ukoliko se neki od naručenih proizvoda ne nalaze na zalihi
kontaktirati ćemo kupca te mu reći rok dobave artikla.
• rok isporuke proizvoda, koje se nalaze na zalihi, na području cijele Hrvatske
je najkasnije 14 dana od dana zaključene narudžbe, izuzev proizvoda s
posebnom napomenom
• u slučaju primjene roka dostave ili bilo koje druge važne okolnosti za
izvršenje narudžbe, kupca će o tome odmah obavijestiti naša služba za
korisnike
• bazeni4you šalje robu u roku od 48 sati (radni dan), rok dostave ovisi o
dostavnoj službi (najčešće već idući radni dan od dana slanja pošiljke).
• Dostava se obavlja svaki radni dan
IV) Reklamacije i prigovori
Naručeni proizvodi pakirani su na način da se uobičajenom manipulacijom u
transportu/dostavi ne oštete. Kupac je dužan prilikom preuzimanja pregledati
pakiranje pošiljke. Ukoliko pakiranje pošiljke ima vidljivih
oštećenja/nedostataka, preporučujemo da kupac odbije primitak iste jer postoji
mogućnost da je proizvod unutar takvog pakiranja oštećen. Odbijanjem
primitka, dostavna služba će pošiljku vratiti bazeni4you-u, uz napomenu da
pošiljka sadrži nedostatak.
Reklamacije vezane za nedostatke proizvoda te svi ostali prigovori mogu se
izjaviti u pisanoj formi putem elektroničke ili obične pošte:

U slučaju opravdane reklamacije omogućuje se raskid ugovora uz povrat
uplaćenog iznosa ili zamjena proizvoda. Ukoliko se radi o oštećenju i/ili
neispravnosti isporučene robe, kupac treba poslati fotografiju navedene
reklamacije kako bi se ista uvažila na temelju fizičkog dokaza. bazeni4you
internet stranica vrši prikup reklamirane oštećene, neispravne ili pogrešno
isporučene robe o svom trošku, ukoliko se utvrdi da je reklamacija opravdana
te da kupac nije utjecao na neispravnost, oštećenje ili bilo kakav nedostatak
robe. U slučaju opravdane reklamacije trošak zamjene proizvoda s novim u
cijelosti snosi bazeni4you.
U slučaju spora oko opravdanosti reklamacije i/ili načina na koji je proizvod
vraćen (proizvod mora biti nekorišten, u nepromijenjenoj količini te u
originalnoj ambalaži, uz predočen originalan račun i jamstvo, ukoliko postoji)
proizvod će se dati na vještačenje vještaku ili stručnoj pravnoj osobi. U slučaju
da se vještačenjem utvrdi opravdanost reklamacije, sav trošak zamjene
proizvoda snosi bazeni4you, a u slučaju neopravdane reklamacije trošak će
snositi kupac.
Povodom sklapanja Ugovora, korisniku će biti dostavljeni: potvrda o
sklopljenom Ugovoru, odnosno predugovorna obavijest iz članka 57. st. 1.
Zakona o zaštiti potrošača (Narodne novine, br. 41/2014), ovi Uvjeti te
obavijest o pravu korisnika na jednostrani raskid Ugovora s obrascem za
jednostrani raskid Ugovora iz članka 61. st. 1. i 2. Zakona o zaštiti potrošača.
Korisnik može jednostrano raskinuti Ugovor u roku od 14 (četrnaest) dana bez
navođenja razloga. Korisnik nema pravo na jednostrani raskid Ugovora:
– ako mu je usluga u potpunosti ispunjena, a ispunjenje je započelo uz njegov
izričit prethodni pristanak te uz njegovu potvrdu da je upoznat s činjenicom da
će izgubiti pravo na jednostrani raskid Ugovora ako mu usluga bude potpuno
ispunjena,
– ako je predmet Ugovora zapečaćena roba koja zbog zdravstvenih ili
higijenskih razloga nije pogodna za vraćanje, ako je bila otpečaćena nakon
dostave,
– ako je predmet Ugovora roba koja je zbog svoje prirode nakon dostave
nerazdvojivo pomiješana s drugim stvarima
Za kupljenu rabljenu robu ili robu s nedostatkom koja je kupcu napomenuta
prilikom kupovine i zbog toga je roba na sniženju, kupac ne može naknadno
vratiti. - Proizvode je moguće naručiti svakim danom od 0-24. Proizvodi se naručuju
elektronskim putem – putem obrasca. Nakon izvršene narudžbe dobije se
obavijest na email o izvršenoj narudžbi. Kupac je obavezan pratiti email u
slučaju da nakon narudžbe dobije povratni email da neki od artikala nije
dostupan ili da neki od podataka koje je naveo nije ispravan. Pošiljka se neće
slati dok se ne dobiju svi podaci. - Klepić d.o.o. ulaže maksimalne napore u održavanju informacija na
stranicama web trgovine ažurnim i točnim. Ne možemo jamčiti stopostotnu
točnost svih prikazanih informacija o proizvodima i uslugama. U izuzetnim
slučajevima su moguća odstupanja stvarnih podataka i podataka dostupnih na
web stranicama. Klepić d.o.o. se obvezuje u svakom takvom slučaju revidirati
narudžbu i kontaktirati kupca da se osobno dogovori o alternativama. Isto tako,
fotografije proizvoda ne moraju uvijek stopostotno odgovarati proizvodima koji
su stvarno dobavljivi. Za sve dodatne informacije možete nas kontaktirati ili
detalje pogledati na službenim stranicama proizvođaća. - Prodavatelj se obvezuje na www.bazeni4you.com internet stranici redovno
održavati i davati posjetiteljima i kupcima jednoznačne, jasne, lako razumljive
informacije o proizvodima u ponudi, na način prilagođen sredstvima daljinske
komunikacije. U trenutku naručivanja pojedinog proizvoda iz ponude, korisnik
pristajanjem na ove uvjete korištenja potvrđuje da je u primjerenom roku prije
sklapanja kupoprodajnog ugovora (predugovorna obavijest) obaviješten o
glavnim obilježjima robe ili usluge, nazivu i sjedištu, telefonskom broju, e-mail
adresi, zemljopisnoj adresi mjesta poslovanja na koju se mogu upututi
prigovori, maloprodajnoj cijeni robe ili usluge troškovima prijevoza, dostave,
uvjetima plaćanja, uvjetima isporuke robe ili pružanja usluga, vremenu
isporuke robe ili pružanju usluga te načinom rješavanja pritužbi, uvjetima,
rokovima i postupku izvrašavaja prava na jednostrani raskid ugovora,
uslugama koje se nude nakon prodaje (servisiranje i prodaja zamjenskih
dijelova), jamstvima koja se daju uz proizvod ili uslugu, potrošačkom pravu na
raskid ugovora sklopljenog putem sredstava daljinske komunikacije u roku od
14 (četrnaest) radnih dana za raskid ugovora, situacijama u kojima je
isključeno pravo potrošača na raskid ugovora, troškovima uporabe sredstava
daljinske komunikacije kada se taj trošak ne zaračunava po osnovnoj tarifi,
razdoblju u kojem ponuda ili cijena vrijede te ovim uvjetima korištenja. - Kupac nema pravo na raskid Ugovora u slučajevima propisanim člankom 79.
Zakona o zaštiti potrošača. - Kupac ima pravo na povrat proizvoda, na teret prodavatelja u slučaju : a)
Kada je isporučen proizvod koji nije naručen; b) Kada je isporučen oštećeni
proizvod. - U pojedinačnim slučajevima, zbog velike potražnje, moguće je da
prodavatelj neke od naručenih proizvoda neće moći isporučiti, odnosno da su
neki od proizvoda iz ponude u potpunosti ili djelomice rasprodani. U slučaju
rasprodanih proizvoda, kupac će o tome biti obaviješten prije isporuke robe Emailom ili telefonom, te u tom slučaju prodavatelj ne snosi nikakvu
odgovornost. Kupac ima opciju otkazati naručeni proizvod ili zatražiti
zamjenski proizvod. - Prodavatelj će dostaviti kupcu kao potrošaču u smislu odredaba ZZP-a
potvrdu predugovorne obavijesti u pisanom ili nekom drugom, potrošaču
dostupnom trajnom mediju, što je moguće prije, a najkasnije u trenutku
isporuke proizvoda, odnosno najkasnije na dan početka pružanja usluge.
Pristajanjem na ove uvjete korištenja, kupac je suglasan da mu se potvrda
predugovorne obavijesti dostavlja elektroničkom poštom na e-mail adresu koju
navede kao kontakt prilikom unošenja svoje narudžbe ili poštom na kućnu
adresu zajedno s dostavom proizvoda i računom. - Proces upisivanja cijene na internet stranicu za svaki proizvod podložan je
kontroli u više razina no bez obzira na to postoji mogućnost nastanka greške,
budući da se ne radi o automatskom unosu. Takve situacije su izvanredne i za
njih se prodavatelj unaprijed ispričava svojim kupcima jer će ih biti prisiljen
obavijestiti o nastaloj situaciji, pogrešnoj cijeni za određeni proizvod, te
nemogućnosti isporuke po konkretnoj narudžbi kupca. - Prodavatelj je ovlašten mijenjati cijene bez prethodne obavijesti kao što je
ovlašten bez prethodne obavijesti mijenjati cijene isključivo za online kupovinu.
Cijene na web shopu se mogu razlikovati od onih u dućanu, posebno ako je
promotivna akcija. - Svaki korisnik izvršavanjem narudžbe prihvaća korištenje njegovih
podataka u svrhu slanja pošiljke i koristit će se jedino u tu svrhu. - Za svaki proizvod iz asortimana prodavatelja koji je oglašen na
www.bazeni4you.com kupac ostvaruje prava iz jamstva prema jamstvenom
listu određenog proizvoda kojeg kupac dobiva zajedno sa kupljenim
proizvodom. - Kada kupac ostvaruje prava iz jamstva, a što mora biti u skladu sa
jamstvenim listom, tada isti reklamaciju može podnijeti prodavatelju na u ovim
uvjetima naznačenu E-mail adresu i/ili adresu sjedišta prodavatelja ili E-mail
adresu maloprodaje navedenu na internet stranici. - Trgovac je prema pravu EU-a odgovoran za nesukladnost koja postane
očita u minimalnom roku od dvije godine od isporuke robe. Nacionalnim
zakonima potrošaču se mogu osigurati dodatna prava. Odgovornost trgovca za
materijalne nedostatke na proizvodu propisana je člancima 400. – 429
Zakonom o obveznim odnosima, NN br. 5/05,41/08 i 125/11. - Sukladno odredbama Zakona o obveznim odnosima, ovjerom dostavne
liste od strane primatelja smatra se da je pošiljka uručena u neoštećenom
stanju i nakon toga je prijevoznik oslobođen bilo kakve naknadne
odgovornosti. Pošiljatelj će u listi preuzimanja naznačiti referentni broj prateće
dokumentacije, pri čemu će kasnije potpisana dostavna lista s referentnim
brojem biti dokaz o izvršenoj dostavi. - Prilikom preuzimanja dostavljenog proizvoda, kupac je dužan pregledati
isporučeni proizvod i u slučaju vidljivog oštećenja ima pravo odbiti preuzimanje
istog, te tražiti isporuku neoštećenog proizvoda. Potpisom dostavnice i
primitkom računa kupac potvrđuje da je prilikom preuzimanja proizvoda izvršio
njegov pregled. - Za izvršavanje narudžbe nije potrebna registracija na stranici.
- Prilikom korištenja www.bazeni4you.com internet stranice, korisnici su
dužni dati točne, važeće i potpune osobne podatke, naročito prilikom
izvršavanja narudžbe. Suprotno postupanje ovlašćuje prodavatelja da uskrati
takvom korisniku pristup ili uskratiti ostvarenje svih ili dijela usluga, odnosno
proizvoda koje istima nudi. - Ukoliko su pokraj cijena u hrvatskim kunama prikazane i cijene u ostalim
valutama, napominjemo da se valutne cijene izračunavaju prema važećoj
tečajnoj listi i služe isključivo kao informacija prema kojoj se kupac može
okvirno informirati o iznosu u valuti. Naplaćeni iznosi mogu se razlikovati od
onih prikazanih ovdje.
Sva plaćanja će se vršiti u hrvatskoj valuti. - Ukoliko kupac ne preuzme proizvod ili odbije preuzeti proizvod bez
valjanog razloga, prodavatelj zadržava pravo zahtijevati nadoknadu nastalih
troškova. - Cijenu poštarine određuje tvrtka koja vrši prijevoz te Klepić d.o.o. ne
određuje cijenu poštarine. - Ukoliko se želi vratiti naručena roba, cijenu poštarine plaća kupac ukoliko
se ne radi o pogrešci prodavatelja. - U slučajevima kada je kupcu isporučen proizvod različit od onog kojeg je
kupio, isti ima pravo na isporuku naručenog proizvoda, a ukoliko to nije
moguće kupac ima pravo na povrat novca u iznosu plaćene cijene proizvoda,
cijene dostave i naknadu troškova povrata proizvoda te je dužan vratiti krivo
dostavljen proizvod. - Prodavatelj se u potpunosti odriče svake odgovornosti koja na bilo koji
način može nastati iz ili je na bilo koji način vezana za korištenje internet
stranice, te za bilo kakvu štetu koja može nastati korisniku ili bilo kojoj trećoj
strani u vezi s uporabom ili zlouporabom korištenja sadržaja internet stranice. - Sukladno čl. 10 ZZP, prodavatelj omogućuje svim kupcima da svoje
prigovore uputi putem pošte ili elektroničke pošte na adresu prodavatelja ili na
adresu elektroničke pošte prodavatelja bazeni4you@gmail.com ili info@bazeni4you.com te će
prodavatelj obavijestiti kupca o zaprimljenom prigovoru. Na sve primjedbe i
prigovore prodavatelj će odgovoriti najkasnije u roku od 15 dana od dana
zaprimljenog prigovora. - Privatnost korisnika odnosno Cookie policy je objavljena ovdje.
Pristupanjem internet stranici slažete se sa korištenjem kolačić. - Izjava o privatnosti podataka se nalazi ovdje.

- Posebnom regulativom Europske unije, od 15.02.2016. diljem cijele EU

The course and the commercial purpose of the Agreement is the purchase of
selected products through bazeni4you.com website in exchange for payment –
prices that product or service. The contract is concluded the means of distance
communication (contract concluded at a distance) and this through: press
advertising with an order form, telephone with human intervention and without
it, and the Internet.
The contract comes into force and shall be binding from the moment the
customer accepts the offer bazeni4you by selecting payment and completion of
orders via the Internet.
To enable the user to exercise the right to unilateral termination of the
